Any bill like S. 3081 that would grant powers to the executive branch allowing it to designate "enemies of the State" is incredulous. Every time a new law or regulation is passed, it grows and becomes twisted so as to apply beyond its original intent. (..unintended consequences..!) To grant such sweeping powers to the president is reminiscent of another leader's 'rise to power' and the German word "Ermächtigungsgesetz" ( "the enabling act." ) -- rfh
The German word Ermächtigungsgesetz usually refers to the enabling act of March 23, 1933, officially Gesetz zur Behebung der Not von Volk und Reich ("Law to Remedy the Distress of the People and the State"). It became a cornerstone of Adolf Hitler's seizure of power. Unlike, for example, the Wilhelm Marx enabling act of December 1923, Hitler's act

- enabled government not only to create decrees, but even laws and treaties with other countries

An enabling act is a piece of legislation by which a legislative body grants an entity which depends on it for authorization or legitimacy the power to take certain actions. For example, enabling acts often establish government agencies to carry out specific government policies in a modern nation state. The effects of enabling acts from different times and places vary widely. We have a constitutional crisis in this country. This crisis isn't being precipitated by any one party or any one ideology--all across the board, politicians of all stripes are implementing rules, regulations, agencies, and laws that clearly go against every fundamental principle of our constitutional republic. Have these entrenched politicians NEVER picked up a copy of the Constitution and read it? Have they no idea HOW this republic is supposed to work?
Or are they on such a mad, power-hungry high to grab complete control of our lives that they just don't care anymore? I think they're power-hungry crazy. I think they have lost every last bit of common sense and control. I think they operate without a shred of decency or concern for the Constitution. And I think that if we as the "people" don't stand up and fight back, we're doomed. Introducing Senate Bill 3081 [ ... in the last session of Congress, the 111th. -- rfh] Senate Bill 3081 is called The Enemy Belligerent, Interrogation, Detention, and Prosecution Act of 2010. It was introduced by Senator John McCain, but he acted in behalf of Senators Lieberman, Inhofe, Brown, Wicker, Chambliss, LeMieux, Sessions, and Vitter, all who co-sponsored the bill. First let's note two things right off the bat. One - Senator John McCain is a Republican. Yes, he's a "republican in name only" (RINO) as far as many people are concerned, but he wears the label of the Republican party, has the full-court approval of the Republican party, and has run for president on that same ticket. He is a senior member in the Senate, with many years under his belt. Two - this bill was introduced March 2010. March 2010. Have you heard about it at all? Has there been an outcry over this bill in any media outlet? Do common every day Americans who are busy working and trying to survive, who don't have time to peruse and glean information from various Internet news sites and blog spots even know that such a bill is before Congress?
The horrible consequences if this bill makes it into law are astonishing. I'm not being overly emotional or incendiary when I say that this gives Gestapo-like powers to the federal government in its day-to-day interactions with the American citizenry. Will YOU be labeled an "enemy combatant?" Don't laugh. Janet Napolitano and her security council have classified what many would call "core" Americans as potential terrorists:
- Do you believe in a right to life? Then you're suspect...
- Are you an American soldier returning from war? Oh gosh, we better get surveillance on you...
- Do you sport a Ron Paul bumper sticker on your car? Maybe you should be detained...
- Do you believe in the Constitution and have a copy of it? Well, you're the biggest threat of all...
Senate Bill 3081 from the 111th Congress would have allowed the U.S. military to indefinitely detain U.S. citizens that were considered a terrorist threat, "without being charged with a crime, without being read a Miranda warning, without trial, without access to their 5th and 6th Amendment rights and without their rights under Article 3 Section 3 of the Constitution based on suspected activity." And who gets to determine the definition of a "potential terrorist threat?" Why the executive branch of our government - the president and his security advisors. Are you feeling all warm and fuzzy yet?
What lunatic in Congress would grant the president such wide-sweeping, unconstitutional authority? That supposedly "conservative" senators are co-sponsoring this bill is unconscionable! Perhaps it's time that we introduce the precise wording of the Constitution to our senators and congressmen since it's obvious they have NO idea what's in there! Or they could just be like one Illinois congressman who just doesn't "worry about the Constitution." We are NOT a democracy. We do not govern by majority vote. We are a Republic with a government based upon rule of law. That law is enshrined in the Constitution. However, we can hardly hold our representatives' and senators' feet to the fire and to the letter of that document if we don't even know what's in it ourselves. How Familiar Are You With the Founders' Plan? Let's face it...our country is in trouble. And ignorance and apathy play a large part in where we find ourselves today. Our public schools no longer teach civics or the responsibility of the citizens to get involved in this great experiment called the United States of America. Our school boards would rather allow LaRaza leftist revolutionary ideology to be taught to 3rd graders (such as the most recent charge brought before the Tucson area school board by a concerned mother), than to teach them what our Founders envisioned for this country, the political system that they set up, the checks and balances that are inherent in that system, and their responsibility to this country and her government.
If you're like me, you know that all the greedy power-grabs our politicians are engaged in are unconstitutional. You're just unsure of arguing your position because you can't cite historical facts, so you remain quiet. And the power grabs continue and ramp up in intensity.
Don't sit around watching as your congressmen and senators dismantle this nation one bill, one resolution, one agency, and one law at a time. Become informed.
